Since 2 February 2025, every company whose AI output is used in the EU must give staff a “sufficient level of AI literacy.” The catch:

  • The regulator deliberately didn't say how many hours, which curriculum, or what counts as “sufficient.”

  • From 2 August 2026, national market surveillance authorities can supervise and sanction — penalties are set by each member state's national rules, and weak AI literacy aggravates exposure under the Act's other duties.

Does Article 4 really apply to my company?
If your staff use AI tools (ChatGPT, Copilot, Claude, etc.) and your output reaches the EU — yes. The duty is extraterritorial, like GDPR. It has applied since 2 February 2025.
What fine can my company face under Article 4?
Precisely: the AI Act sets no fixed EU-level fine for Article 4 itself — penalties are left to each member state's national rules (Article 99(1)), applied by national market surveillance authorities from 2 August 2026. The realistic exposure for an SME is broader: weak AI literacy aggravates breaches of other AI Act duties, weakens your position in liability claims, and fails the due-diligence questionnaires EU clients increasingly send. We tell you this straight because vendors who wave "€7.5M fines" at you are misquoting the Act.
Didn't the 2026 "Digital Omnibus" change Article 4?
Yes — and the kit reflects it. The provisionally agreed Digital Omnibus on AI (May 2026) rewords the duty to "take measures to support the development of AI literacy" rather than "ensure a sufficient level" of it. The application date (2 Feb 2025) and enforcement date (2 Aug 2026) are unchanged, and a documented policy + training + evidence record remains exactly what the amended duty calls for.
